READ THIS AGREEMENT CAREFULLY BEFORE USING THIS SOFTWARE LIBRARY. BY USING THIS SOFTWARE LIBRARY YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS HEREOF.
This Software Library contains shareware, utilities or other software (the "Products"), available for download as well as other content relating to the Products. The Products contain data and software which are proprietary products of third parties, I (Chris Drake) or its affiliates ("Content Providers") and are protected by copyright laws. Each Content Provider retains ownership of the copyright to its Products. The articles and other content in this Software Library (other than the Products) and their compilation are proprietary to Chris Drake and are protected by copyright laws.
You are responsible for installation, management, operation and support of the Products. Your right to use each Product is governed by any specific terms and conditions provided by the Content Provider with such Product ("Product License"). You shall not (and shall not permit any third party to) remove or obscure any Content Provider's copyright, trademark or other proprietary notices or legends or any end-user terms and conditions (whether contained in the Product License or elsewhere) from any Product or any downloaded copy of any Product.
The Products are subject to their States origin export control laws. You are responsible for compliance with such laws and regulations in connection with any Products that you download and for obtaining any licenses or permits required to export or re-export such Products.
CHRIS DRAKE IS NOT RESPONSIBLE FOR THE QUALITY, PERFORMANCE OR ANY OTHER ASPECT OF THE DOWNLOAD OR OPERATION OF THE PRODUCTS, EXCEPT AS MAY BE EXPRESSLY STATED IN ANY PRODUCT LICENSE. CHRIS DRAKE IS MAKING THE PRODUCTS AVAILABLE TO YOU ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, THEIR QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, AND ASSUMES NO RESPONSIBILITY FOR THE ACCURACY OR APPLICATION OF OR ERRORS OR OMISSIONS IN ANY DATA OR SOFTWARE CONTAINED IN THE PRODUCTS. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCTS IS ASSUMED BY YOU. IN NO EVENT WILL CHRIS DRAKE BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCTS, EVEN IF CHRIS DRAKE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE RECOURSE WITH RESPECT TO ANY PRODUCT IS TO THE CONTENT PROVIDER OF THAT PRODUCT IN ACCORDANCE WITH ANY TERMS AND CONDITIONS ACCOMPANYING THAT PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. This agreement shall be governed by the laws of the Commonwealth of Massachusetts.
